Acceptance of the Terms of Service

These Terms of Service cover all Widepilot games, websites, player accounts, and everything related to them (collectively "the Services"). This is a binding agreement between you and Widepilot, which we'll refer to as the "Company", "we", or "us". What follows is what governs how you can access and use the Services. BY USING THE SERVICES, YOU AND ON BEHALF OF ANY CHILDREN IN YOUR CARE, AGREE TO BE BOUND BY THESE TERMS. IF YOU DON'T AGREE WITH ANY OF THIS, YOU SHOULDN'T USE THE SERVICES.

Modifications to the Terms of Service and to the Services

We can update these Terms whenever we decide to. When we do, those changes take effect as soon as they're posted here. It's on you to check back and read them periodically. If you keep using the Services after we make changes, you're accepting them. We can also change, update, or remove parts of the Services themselves whenever we want. We're not responsible if something stops working or becomes unavailable because of it.

Use of the Services

Your information matters to us, and we use reasonable security measures to keep it safe from being accessed or shared without permission. You're responsible for your own access to the Services. Make sure anyone else using your connection follows these Terms too. Any information you give us needs to be accurate, current, and complete. If something changes, let us know right away. Nothing sent over the internet is completely secure. We do what we can to protect your information, but we can't promise it will never be intercepted. You use the Services at your own risk, and we're not liable if someone manages to get around your privacy settings. You can't do any of the following: access content or data you're not meant to see, get around our security, mess with the service for other people, mess with packet headers, disrupt network services, use bots or automated tools, introduce viruses or malware, launch denial-of-service attacks, or otherwise interfere with how the Services work.

Account Set-up and Subscription Services

To use certain parts of the Services, you'll need to create an account with a username and password (your "Login Credentials"). You have to be at least eighteen years old. You can also sign in using your Apple ID or Google account. Don't share your Login Credentials with anyone. You're responsible for everything that happens with your account. We can terminate any account at any time if we want. Some Services are membership-based and require you to buy a subscription ("Subscription") either on our website or through the Apple App Store or Google Play Store. Your subscription works across all your devices. Certain content is only available if you have an active subscription. Subscriptions come in different lengths: one month, six months, or one year. We can change the price, but we'll give you written notice and the new price takes effect at the end of your current period. Subscriptions automatically renew unless you cancel before the renewal date. When it renews, it's for the same length of time as before. Your payment method gets charged automatically. If we can't charge you, you lose access. You can cancel anytime through "My Account" or through the app store itself. You'll keep access until the end of your current period, then it stops with no further charges.

Intellectual Property Rights and Ownership

Everything in the Services, including all the content, features, functionality, information, software, text, graphics, videos, audio, design, and how things are selected and arranged, belongs to us and is protected by copyright, trademark, and other intellectual property laws. All the trademarks and logos you see are either ours or belong to someone else. You can't use them without getting permission in writing first. Using them without permission is infringement and could break the law. You can only use the Services for your own personal, non-commercial use. Don't remove our legal notices or change the content. You can't copy it, share it, make something new from it, display it publicly, republish it, download it, or pass it along unless we specifically say you can. Here's what we do allow: your browser can temporarily cache pages, you can download reasonable copies for yourself as long as you keep our notices on them, and you can share things the way certain platforms are set up to allow. Breaking these rules means you lose access. You might have to return or destroy any copies you made. You don't own anything. Misusing the Services breaks these Terms and could violate intellectual property laws.

User Submissions and Conditions of Use

We're not asking for confidential information through the Services. If you do submit materials, content, ideas, or anything else ("User Submissions"), you're saying it's original, nobody else has rights to it, and you're giving up any moral rights you might have. You're also giving us a non-exclusive, royalty-free, perpetual, worldwide license to use those submissions however we want, commercially or otherwise, without paying you. We can delete submissions whenever we feel like it. When you use the Services, you're promising that you won't do anything illegal, violate anyone else's rights, include anything exploitative or obscene or threatening or hateful or sexually explicit, stalk or exploit anyone, make false claims, or pretend someone endorses something when they don't.

Enforcement, Suspension, and Termination

We have the right to: Deal with any User Submissions that violate these Terms or our policies. Take legal action, which could mean involving law enforcement or telling people if we think something illegal is happening. We'll cooperate fully with court orders if someone asks us to identify a user. Suspend or terminate your access to the Services for basically any reason, including if you break these Terms. YOU'RE GIVING UP YOUR RIGHT TO SUE US FOR ANYTHING THAT HAPPENS WHEN WE INVESTIGATE VIOLATIONS OR WORK WITH LAW ENFORCEMENT.

No Reliance

The content in the Services is just general information. It's not advice, and you shouldn't treat it as something you can count on. Before you do anything based on what you read, talk to a professional. We try to keep the content updated, but we're not making any promises that it's right, complete, or current. Using it is your call. We're not liable for anything that happens because of how you use the Services.

Privacy

When you use the Services, you're agreeing that we can collect, use, send around, and share your information the way our Privacy Policy describes. If you don't like that, don't use the Services.

Third-Party Websites

The Services might link to other sites, but we're not vouching for them. You use them at your own risk. We don't control what's on those sites and we're not responsible if something goes wrong because you went there. You're subject to their terms, not just ours. You can link to the Services as long as you do it in a fair, legal way that doesn't damage our reputation. Don't frame the Services or make it look like we're endorsing something we're not. We can take back linking permission whenever we want without telling you first. If you're doing something we don't approve of, you need to stop immediately when we say so.

Online Purchases

Orders, subscriptions, and purchases go through third-party providers called Shopify and Stripe. They have their own terms and policies that apply, and we're not responsible for them. Before you buy anything, read what they have to say.

Copyright Complaints

We take copyright infringement seriously. We've put processes in place to handle notices, and we respond to ones that follow the law. If you think something infringes your copyright, send us a written notice at the address below. Your notice needs to include: a signature from someone authorized to act on behalf of the copyright holder, what the copyrighted work is, where it's located on the website, how we can reach you, a statement saying in good faith that the use isn't authorized, and an acknowledgment that you understand the penalties for lying. If you're sending a counter-notice because you think something was removed by mistake, include your signature, what material was removed, a good faith statement that the removal was wrong, your full contact information, and that you agree to the jurisdiction of the court.

Disclaimer of Warranties

YOU'RE USING THE SERVICES AT YOUR OWN RISK. THEY'RE PROVIDED "AS IS" AND "AS AVAILABLE" WITH NO WARRANTIES, EITHER STATED OR IMPLIED, INCLUDING NO WARRANTIES ABOUT BEING FIT TO SELL, FIT FOR A PARTICULAR PURPOSE, OR NOT INFRINGING ANYONE'S RIGHTS. WE'RE NOT MAKING ANY PROMISES ABOUT HOW COMPLETE, SECURE, RELIABLE, ACCURATE, UP-TO-DATE, OR AVAILABLE THE SERVICES ARE. THEY'RE NOT GUARANTEED TO BE ACCURATE, RELIABLE, ERROR-FREE, OR ALWAYS WORKING. WE CAN'T PROMISE THAT FILES ARE VIRUS-FREE. YOU'RE ON YOUR OWN WHEN IT COMES TO SECURITY. WE'RE NOT RESPONSIBLE FOR DENIAL-OF-SERVICE ATTACKS, MALWARE, VIRUSES, OR ANY DESTRUCTIVE CODE THAT AFFECTS YOUR EQUIPMENT OR DATA BECAUSE YOU USED THE SERVICES OR DOWNLOADED SOMETHING FROM THEM.

Limitation on Liability

UNLESS THE LAW SAYS WE CAN'T, WE'RE NOT LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES. THIS INCLUDES PERSONAL INJURY, EMOTIONAL DISTRESS, LOST REVENUE, LOST PROFITS, LOST BUSINESS, LOST USE, LOST GOODWILL, OR LOST DATA, WHETHER IT'S BECAUSE OF A BREACH OF CONTRACT, A TORT, OR SOMETHING ELSE, AND WHETHER OR NOT IT WAS FORESEEABLE. UNLESS THE LAW SAYS WE CAN'T, THE TOTAL AMOUNT WE'RE LIABLE FOR BECAUSE OF THE SERVICES WON'T EXCEED WHAT YOU PAID US IN THE MONTH BEFORE YOU MADE YOUR CLAIM.

Indemnification

To the fullest extent allowed, you agree to defend, indemnify, and hold harmless us and our associated parties from any claims, liabilities, damages, judgments, losses, costs, and expenses that come from you breaking these Terms or using the Services, including your submissions, third-party sites you use, or any unauthorized use of the Services.

Governing Law and Choice of Forum

These Terms and the Services are governed by the laws of Ontario and Canada, without regard to which laws might normally apply based on where you live. Any dispute about the Services has to be brought in the courts of Ontario. Both of us agree to that jurisdiction. You're waiving any objection you might have about where the case gets heard or what court has authority. BY AGREEING TO THESE TERMS, YOU'RE GIVING UP YOUR RIGHT TO BE PART OF A CLASS ACTION LAWSUIT AGAINST US.

Waiver

If we don't use a right, that doesn't mean we're giving it up. Not using something once doesn't stop us from using it later.

Severability

If a court decides that one part of these Terms is invalid or can't be enforced, that doesn't invalidate the rest or make it unenforceable in other places.

Entire Agreement

These Terms along with our Privacy Policy make up the whole agreement about the Services. They replace anything we said or agreed on before.
